  North Carolina Defender Manual, Volume One, Pretrial

  Volume One addresses various pretrial topics, such as discovery, capacity
  to proceed, and motions for experts. This is a useful reference both for
  public defenders and others who work in the criminal courts.

  Volume Two of the North Carolina Defender Manual, a reference in the
  School’s Indigent Defense Manual Series, is a resource for public
  defenders and appointed counsel who represent poor people accused of
  crimes. The book focuses primarily on criminal procedure at the trial
  stage. Fifteen chapters cover a variety of topics such as:

  • personal rights of the defendant,
  • selection of the jury,
  • opening and closing arguments,
  • witnesses, and
  • appeals, post-conviction litigation, and writs.

This manual is also useful to others who work in the court system and who need a reference source on the law. It replaces the first edition dated 2002-2005.

Authors are currently working on an update to Volume One, Pretrial.

  North Carolina Civil Commitment Manual, Second Edition

  Designed to assist the attorney representing a respondent or minor in
  civil commitment proceedings, this manual reviews North Carolina mental
  health and substance abuse laws pertaining to inpatient and outpatient
  commitments and admissions. It analyzes in depth the relevant statutes
  in Chapter 122C of the North Carolina General Statutes and applicable
  case law. It also discusses the collateral consequences resulting from commitment and the special provisions on commitment of respondents involved with the criminal justice system. Although the manual’s focus is on commitments and admissions requiring judicial review, and thus on proceedings requiring the appointment of counsel, the manual is a clear, usable resource for anyone who works in this challenging area of law.

  North Carolina Guardianship Manual

  This manual discusses the role and responsibilities of attorneys who are 
  appointed to represent allegedly incapacitated respondents in adult
  guardianship proceedings. It summarizes and analyzes relevant
  provisions of North Carolina's guardianship law (Chapter 35A of the North
  Carolina General Statutes); discusses the legal consequences of   guardianship and the relationship between adult guardianship and other  laws regarding mental incapacity; jurisdiction, procedure, and evidentiary issues in adult guardianship proceedings; the legal standards for determining incapacity in adult guardianship proceedings; clinical assessment of cognitive and functional incapacity in adult guardianship proceedings; the appointment of guardians for incapacitated adults; mediation of adult guardianship cases; appeals in adult guardianship proceedings; and modification and termination of adult guardianship.   North Carolina Juvenile Defender Manual

  representing juveniles in delinquency proceedings, from intake to
  disposition and beyond in this useful handbook. The topics include:
