April 2008 Update

The 2007 General Assembly amended G.S. 160A-168(b) and G.S. 153A-98(b), which govern the disclosure of information from city and county employee personnel files, respectively. Under both statutes, public information now includes the terms of an employee’s employment contract, whether the contract is written or oral. The terms “salary” and “compensation,” as they are used in both statutes, have been defined to include pay, benefits, incentives, bonuses, and deferred and all other forms of compensation paid by the city or county employer.
