New Resource on the Authentication and Admissibility of Digital Evidence

Last week I participated in a CLE event sponsored by the Eastern Band of Cherokee Indians Tribal Court. It was a great event and an opportunity for me to learn about Cherokee history, culture, and institutions.

My main role at the CLE was to teach a session on the authentication and admissibility of digital evidence, drawing on North Carolina and federal law. Regular readers may remember that I wrote a book about digital evidence. The book addresses authentication and admissibility, but it is more than ten years old. Important cases have been decided since it was published.

As part of my preparation for my session, I wrote a detailed manuscript on authentication and admissibility. It draws on the most recent and significant cases I could find. I thought it might be helpful to a broader audience, so I am making it available here: Manuscript on Authentication and Admissibility of Digital Evidence.
