10A N.C.A.C. 71A .0503

Requires DSS to provide certain information to the Division of Health Services Regulation:
If, in the course of an evaluation, evidence of abuse, neglect or exploitation is found, DSS must notify the Division immediately by telephone. Also requires DSS to report if the need for protective services will be substantiated.
Requires DSS to provide a copy of the written report required by 10A N.C.A.C. 71A .0901 within 30 days of completion of the evaluation. Also requires that DSS provide a copy of the report to the Division of Medical Assistance if evidence of financial exploitation is found in Medicaid-funded facilities.
Requires DSS to provide the identity of the reporter and individuals who provide information about the disabled adult if the Division requests it to carry out an investigation. Specifies that DSS may only provide this information verbally.
When it appears that a need for protective services will not be substantiated, but DSS finds violations of licensure standards, it must report violations of standards in nursing and combination facilities and residential care facilities licensed under G.S. 122C to the Division. Violations of standards in residential care facilities licensed under G.S. 131D-2 must be made to the adult home specialist in DSS.
