14B N.C.A.C. 11A .0302

G.S. 7B-3100 requires the Division of Juvenile Justice of the Department of Public Safety to adopt rules designating local agencies that will be required to share information concerning juveniles who are alleged to be abused, neglected, dependent, delinquent, or undisciplined. The designated agencies are identified in 14B N.C.A.C. 11A. 0302.
This regulation adds two new requirements to this mandated information sharing.
Documentation of disclosure: If an agency shares information with another agency pursuant to this law, it must document the disclosure, including the name of the agency and the date provided.
Interaction with federal law:  If a federal law restricts or prohibits a disclosing agency's ability to share information with a requesting agency, the disclosing entity must comply with the federal law. The requesting entity may ask the disclosing entity to identify the law that restricts or prohibits the disclosure.
