  • The court may consider a parent’s conduct toward the child prior to their adjudication so as to assess the likelihood of future neglect for TPR.
  • Findings are supported by the evidence, and to the extent there were slight discrepancies between the evidence and findings, they were harmless.
  • Facts: Years after the children were adjudicated neglected and dependent, DSS petitioned to terminate both parents’ parental rights on the grounds of neglect.  Respondent mother’s parental rights were terminated on the ground of neglect after the court found the likelihood of future neglect was high due to the mother’s failure to address her mental health issues and complete the domestic violence program, and her unstable relationships and housing.
