In the Matter of J.J., Jr., 216 N.C. App. 366 (2011)

Held:
No Error
Reversed and remanded in part

The failure of the adjudication order to state findings that were made “beyond a reasonable doubt,” although stated in open court, required remand. The court noted that the “Juvenile Adjudication Order” entered by the trial court contained a blank space for the court to state its findings of fact which the court found to be proved beyond a reasonable doubt. The court failed to use this space and made no written findings at all. Therefore, the Court of Appeals vacated the adjudication order and remanded for the trial court to make the requisite findings.
