Annexation Statutes

G.S. Chapter 160A, Article 4A.  Extension of Corporate Limits.

This Article includes most of the annexation-related statutes.  It includes each of the annexation procedures, plus(1) the statute that governs liability for property taxes of property included within an annexation and (2) the statutes that authorize two or more municipalities to enter into annexation agreements, by which they agree on “spheres of influence” into which only one of the agreeing municipalities may annex.

G.S. 69-25.15.  When district or portion thereof annexed by municipality furnishing fire protection.

This section governs the effect on a rural fire protection district when a municipality annexes a portion of the district.

G.S. 153A-304.1.  Reduction in district after annexation.

This section governs the effect on a county service district established for provide fire protection, when a municipality annexes a portion of the district.

G.S. 160A-294.  Loss of rural fire employment.

This section requires a city to provide employment to a firefighter employed by a rural fire department when an annexation causes the fire department to terminate the firefighter’s employment with the department.

G.S. 160A-324.  Contract with private solid waste collection firm(s).

The section sets out the protections afforded to private solid waste collection firms when the General Assembly annexes property to a city and thereby affects customers of the private firms.  (The two involuntary annexation statutes, included in G.S. Chapter 160A, Article 4A, each contain an identical statute protecting private solid waste collection firms.)
