Recruitment and Selection Law for Local Governments
The law governing hiring is a patchwork of rules. This two-day course focuses on how North Carolina local governments can comply with and use the law to grow a workforce with excellent training and skills, that is reliable and motivated, has a commitment to public service and reflects the communities that these employees serve. The class will begin with an overview of the state and federal laws that regulate and impact recruitment and selection, before looking more closely at the different stages of the hiring process. Topics covered include:
- The current status of anti-discrimination law in the hiring context
- Defining and advertising the job
- Local policies: the legal issues raised by residency requirements and anti-nepotism policies
- Lawful and Unlawful Questions on Applications and in Interviews
- Physical and Written Testing of Applicants
- Background Checks: Criminal Records, Credit Checks and Internet Searches, Using E-Verify
- ADA Accommodations for Applicants
- Hiring Employees versus Engaging Independent Contractors
Attendance at the Recruitment and Selection Law course should count toward 3 of the 50 points needed for IPMA-HR recertification, 7 of the 60 PDCs needed for SHRM-CP and SHRM-SCP recertification, and 7 of the 60 credits needed for PHR or SPHR recertification. While the course is not a pre-approved program for IPMA, SHRM or HRCI recertification, we will provide you with a certificate of completion and a syllabus which you can use to apply for your credits from those organizations. The course material is consistent with the continuing education requirements of all three organizations.
The course will provide 7.5 hours of NC Bar CLE credit.
