As to neglect.

  • When supported by clear and convincing evidence, findings of trial court are conclusive even when some evidence supports different findings.
  • Facts: In 2013, DSS filed a petition alleging the children were neglected and dependent and introduced evidence the children witnessed domestic violence between their parents, going back to 2008, were coached to make allegations, and the mother refused to develop an in-home services agreement with DSS to address the issues. The mother testified she hesitated but did not refuse to develop a plan.
