  •  Dependency box on the order was inadvertently checked. When a clerical error on a trial court’s order is discovered on appeal, it should be remanded for correction and ensure the record “speaks the truth.”
  • Facts: in 2013, DSS filed a petition alleging the children were neglected and dependent but only pursued an adjudication of neglect at the adjudicatory hearing.  At the conclusion of the adjudication hearing, the court made an oral finding that children were neglected, but the written order adjudicated the juveniles as neglected and dependent.
