In the Matter of A.V., 188 N.C. App. 317 (2008)

Held:
Affirmed

Counsel’s failure to renew a motion to dismiss at the close of all the evidence did not constitute ineffective assistance of counsel because substantial evidence supported the allegations in the petition that the juvenile assaulted a government employee in violation of G.S. 14-33(c)(4), and the juvenile could not show that he was prejudiced by counsel’s error.
