In the Matter of S.D.R., 191 N.C. App. 552 (2008)
Held:
No Error
The trial court properly denied the juvenile’s motion to dismiss a felonious breaking and entering petition where the evidence showed that the juvenile entered an office in the public building where he was completing community service, without permission to be there, and took money from the director’s purse. Although the juvenile was properly in the building, he did not have consent, implied or otherwise, to enter the director’s office, which was not a space held out for public use.
