In the Matter of S.S., 193 N.C. App. 239 (2008)

Held:
Affirmed

Delaying the disposition for more than six months after adjudication, so the juvenile could comply with an agreement to testify truthfully in a co-offender’s trial, did not deprive the court of subject matter jurisdiction under G.S. 7B-2501(d). This statute is intended to provide an opportunity for families to seek non-judicial solutions for troubled juveniles and is not a limit on the trial court’s jurisdiction in juvenile matters. In this case, conducting the disposition hearing within six months would have deprived the juvenile of the benefit of the dispositional agreement with the prosecutor.
