In the Matter of Z.T.W., 238 N.C. App. 365 (2014)

Held:
Affirmed

Due to the lack of a file stamp on the trial court’s orders finding the juvenile to be in willful violation of his probation, ordering an out-of-home placement, and placing him in secure custody pending the out-of-home placement, it was unclear whether the juvenile gave notice of appeal in a timely manner, pursuant to G.S. 7B-2602. Recognizing this issue, the juvenile filed a cert petition simultaneously with his brief. Because the juvenile may have lost his right to appeal through no fault of his own, the court granted the petition to review the appeal, pursuant to Rule 21(a)(1).
