S.L. 2014-2 amends G.S. 87-98.12, the state law establishing education requirements for certified well contractors. Prior law required well contractors to complete continuing education hours to maintain certification, and authorized the Well Contractors Certification Commission to set the number of required continuing education hours. The amendments establish an initial education requirement for well contractors and remove the requirement for continuing education, with a limited exception for contractors required to receive remedial continuing education following a disciplinary action.
Under the new law, contractors must complete two hours of education approved by the Well Contractors Certification Commission during each of the first three years of the contractor’s certification. The law expressly prohibits the Commission from requiring a certified well contractor to obtain continuing education credits after the third year of certification, unless the contractor has been the subject of disciplinary action by the Commission. In that case, the Commission may require a contractor to complete continuing education for remedial purposes.
The current rules of the Well Contractors Certification Commission contain continuing education requirements established under the old law. The new legislation supersedes those requirements and directs the Commission to adopt or amend its rules in accordance with the changes to the statute. The legislation was effective May 29, 2014.
