In re T.H., 232 N.C. App. 16 (2014)

Held:
Remanded in part
  • Visitation must be ordered unless the court finds the parent forfeited his or her right to visitation or that it was in the child’s best interests to deny visitation. The visitation plan that is ordered by the court must contain a minimum outline of time, place and conditions.**

** Since the order in the underlying action was entered, S.L. 2013-129 was enacted to add G.S. 7B-905.1, which specifically addresses visitation. The statute requires the order to address the frequency, duration, and level of supervision for the visitation; location is not included.
